1. Agreement to Terms

By accessing or using BotBuilder ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. BotBuilder is operated by Avish Kunwar ("we", "us", "our").

2. Description of Service

BotBuilder is a software-as-a-service (SaaS) platform that allows users to create AI-powered chatbots for their websites. The Service is powered by Claude AI (Anthropic) and enables businesses to provide automated customer support.

3. Account Registration

You must create an account to use the Service. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and current information during registration
• Notifying us immediately of any unauthorised use of your account

You must be at least 16 years old to use this Service.

4. Subscriptions and Payments

BotBuilder offers paid subscription plans. By subscribing to a paid plan:

• You authorise us to charge your payment method on a recurring monthly basis
• Payments are processed securely by Stripe. We do not store your card details
• Subscriptions renew automatically unless cancelled before the renewal date
• Prices are shown in USD and are subject to change with 30 days notice
• No refunds are provided for partial months of service

5. Free Trial

We may offer free trials at our discretion. At the end of a free trial, your account will be downgraded to the free tier unless you subscribe to a paid plan. No credit card is required to create an account.

6. Acceptable Use

You agree not to use BotBuilder to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Transmit spam, malware, or malicious content
• Collect user data without proper consent or disclosure
• Engage in deceptive, misleading, or fraudulent practices
• Reverse engineer, decompile, or attempt to extract the source code
• Resell or sublicense the Service without written permission
• Use the Service for anything illegal, harmful, or offensive

We reserve the right to suspend or terminate accounts that violate these terms at any time without notice.

7. Your Content

You retain ownership of all content you upload to BotBuilder (knowledge bases, FAQs, business information). By uploading content, you grant us a limited licence to process and store it solely to provide the Service.

You are solely responsible for ensuring your content does not violate any third-party rights, applicable laws, or these Terms.

8. AI-Generated Responses

BotBuilder uses Claude AI (Anthropic) to generate chatbot responses. You acknowledge that:

• AI responses may occasionally be inaccurate or incomplete
• You are responsible for reviewing and maintaining your chatbot's knowledge base
• We are not liable for any decisions made based on AI-generated responses
• AI usage is subject to Anthropic's usage policies

9. Message Limits

Each plan includes a monthly message allowance. When the limit is reached, your chatbot will stop responding until the next billing cycle or until you upgrade your plan. Unused messages do not roll over.

10. Intellectual Property

The BotBuilder platform, including its design, code, branding, and features, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without written permission.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

To the maximum extent permitted by law, BotBuilder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

13. Cancellation and Termination

You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period. We may terminate or suspend your account immediately if you violate these Terms.

Upon termination, your right to use the Service ceases and we may delete your data after 30 days.

14. Changes to Terms

We may update these Terms at any time. We will notify you by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.
